Protection of personal data is among the top priorities of Characterix Eğitim Hizmetleri A.Ş. (hereinafter referred to as “Characterix”) and it makes every effort to comply with all applicable legislation in this regard. 

1.1 With this Personal Data Protection, Processing and Privacy Agreement ( "Agreement" ), provisions parallel to the regulations contained in the Law on the Protection of Personal Data No. 6698 of the Republic of Turkey ( "KVKK or Law" ) are introduced and data subjects are informed to ensure the required transparency. In full awareness of our responsibility in this regard, your personal data is processed and protected under this Agreement. 

1.2 In order to fulfill the disclosure obligation arising from Article 10 of the Turkish Republic’s Law No. 6698 (KVKK), we present the following explanations to our customers and third parties using our website. By visiting our website, using our products, and requesting to benefit from the services provided through this site, you are deemed to have accepted the terms and conditions of this Agreement.

Characterix aims to protect, foremost, the privacy of personal life as well as the fundamental rights and freedoms of individuals at the highest level. The relevant legal regulations regarding the processing and protection of personal data shall primarily apply. In this regard, Characterix undertakes and commits to exercise all necessary care to ensure the confidentiality and security of your personal data, and to fulfill all responsibilities arising from the KVKK.

The Personal Data Protection and Processing Policy aims to protect the data automatically obtained of our customers, prospective customers, our employees, as well as the customers and employees of companies working with us in a solution partnership or other persons, and includes the regulations related to them. Characterix reserves the right to update this policy at any time within the scope of changes that may be made in the applicable legislation.

Your personal data may be recorded, stored, updated, disclosed/transferred to third parties where permitted by legislation, classified, and processed in the manners specified in the KVKK by “Characterix Eğitim Hizmetleri A.Ş.” as the Data Controller pursuant to the Turkish Republic’s Law No. 6698, within the framework described in this Agreement.

We process your collected personal data to operate, provide, and develop the Characterix product/services that we offer to our customers. These purposes include: the provision, troubleshooting, and enhancement of Characterix Services; ensuring the functionality of Characterix Services, conducting performance evaluations, correcting errors, and increasing their usability and efficiency by using your personal data. 

5.1 Recommendations and Personalization; We use your personal information to suggest features, products, and services that may interest you by sending advertising, promotions, campaigns, presentations, and similar electronic communications, to determine your preferences, and to personalize your Characterix Services experience. 

5.2 Provision of quality service through collaboration with solution partners; Characterix, which can be used in business life, personal development, and educational life; offers its personality inventory with analytical reporting capability to its customers by conducting online applications and subsequently preparing individual reports, and may be used for providing consultancy services regarding this inventory and the reports. 

5.3 Characterix uses/processes your personal data in the service of obtaining accurate data in the personality inventory accessible through our website, and subsequently creating an individual report to be provided to the customer. The said inventory and reports may be shared with the persons, institutions, and solution partners benefiting from this service, with the customer’s consent. The services we provide to our customers may be used to comply with the requirements of the agreement and technology, and for the purpose of improving our offered products and services. 

5.4 The terms, current status, and updates of the Distance Sales Agreement, Corporate Sales Agreement, or any other agreements concluded with Characterix may be used to contact our customers and relevant parties, and to provide the necessary information. 

5.5 In addition, it may be used by our contracted institutions and solution partners to offer proposals to our customers, to inform our customers about our services, to evaluate customer complaints and suggestions regarding our services, to fulfill our legal obligations, and to exercise our rights arising from the applicable legislation. 

5.6 Your personal data will be processed for the purposes of providing information to public officials upon request and as required by law in matters related to public safety, planning commercial and business strategies, and ensuring the legal, technical, and commercial-operational security of Characterix and the relevant individuals/institutions involved in business relationships.

6.1 Personal data is processed with the explicit consent of the relevant individual. Personal data may be processed without obtaining additional consent from the data subject where it is expressly provided for by law, is necessary for the company's legal obligations, is necessary for the establishment or protection of a right, is necessary for the legitimate interests of the company, and in other cases specified by law. 

6.2 Special Category Personal Data: This refers to personal data concerning an individual’s race, ethnic origin, political opinions, philosophical beliefs, religious, sectarian or other beliefs, appearance and clothing, membership in associations, foundations or trade unions, health, sex life, criminal convictions, and security measures, as well as biometric and genetic data. 

6.3 Special category personal data may be processed by Characterix in accordance with the principles set forth in this Agreement and by taking all necessary administrative and technical measures, including the methods to be determined by the Board. Characterix may process special category personal data for the purpose of providing better service and in accordance with the purposes for which they were collected with the consent of the data subject.

6.4 Regarding data processed through automated systems, Characterix acts in accordance with the law. Information obtained from these data cannot be used against an individual without their explicit consent. However, Characterix may make decisions concerning individuals with whom it will transact by using the data in its own system.

The purpose of processing personal data is parallel to the purpose of data transfer. Personal data may be transferred, in a proportionate manner, to our business partners, solution partners, legally authorized public institutions, and private individuals or organizations as well as third parties, within the framework of the conditions specified in Articles 8 and 9 of the Law, in order to fulfill the service and the requirements of the business relationship.

Your personal data is collected electronically by Characterix through various methods for the purposes of creating a personality inventory and providing inventory application and reporting services. Your personal data may be processed and transferred in accordance with the fundamental principles, data processing conditions, and exceptions provided by law.

We hereby inform you that, as the data subject, you have the following rights in accordance with Article 11 of the Law of the Republic of Turkey. 

9.1 The right to learn whether personal data has been processed,to request information about it if personal data has been processed,to learn the purpose of processing personal data and whether it is used in accordance with that purpose,to know the third parties to whom personal data has been transferred domestically or internationally,to request correction in case personal data has been processed incompletely or incorrectly, andto request that the operation carried out in this context be communicated to the third parties to whom personal data has been transferred. 

9.2 Notwithstanding that personal data have been processed in accordance with the Law and other relevant legal provisions, in the event that the reasons necessitating their processing cease to exist, you have the right to request the deletion or destruction of your personal data and to require that the action taken in this regard be communicated to the third parties to whom the personal data have been transferred;to object to any decision affecting you solely based on the analysis of the processed data by automated systems;and to claim compensation in the event that you suffer damage due to the unlawful processing of your personal data. 

9.3 You may submit your applications regarding the rights listed above by filling out the contact form available on our website and sending it to our institution. Depending on the nature of your request, your applications will be processed free of charge within the shortest possible time and no later than thirty days; however, if the process requires additional costs, a fee may be charged according to the tariff determined by the Personal Data Protection Board. Our institution may accept and process the request or reject it by providing an explanation.

Your personal data is classified as "Confidential Information." All necessary technical and administrative measures are taken by Characterix to protect the personal data collected and to prevent it from falling into the hands of unauthorized persons, ensuring that our customers and prospective customers do not suffer any harm. 

10.1 Within this framework, it is ensured that the software complies with the standards and that the data protection policy is observed within the company. Characterix shares individuals’ inventories and reports with the person’s consent. Characterix will take the necessary measures to ensure that its solution partners and the individuals/institutions with which it has business relationships also act in accordance with this confidentiality. For the confidentiality and security of your personal data, Characterix follows evolving technology and develops and updates its measures.

The person administering the personality inventory must adhere to the informational texts provided on our website regarding the implementation of the inventory and must complete the inventory by sincerely entering accurate data. Only in this case can the report results be efficient. Although these personality inventories are based on the scientific research conducted by Characterix over the years and on its proprietary software, there is always a margin for error regarding the reliance on the user’s statement. 

11.1. The result reports do not guarantee accuracy. This inventory is not intended to provide a good/bad evaluation. The individual acknowledges and declares that they will not engage in any dispute regarding the accuracy/inaccuracy of the report and values in the inventory result, and that they understand the purpose and nature of the inventory. 

11.2. Characterix reserves the right to change, restrict, or discontinue the scope and usability of its website at any time. Despite its efforts to provide the service without technical failures, maintenance activities, development work, and/or other malfunctions may restrict and/or sometimes suspend usage opportunities. Data loss may also occur during this period. Therefore, Characterix does not guarantee the availability of the service or the prevention of technical malfunctions or data loss.
